Agreement to these terms
These terms apply to dialogicasolutions.com and to any prototype, demo or gallery we give you access to through it (together, the “site”). The site is operated by Dialogica Solutions, LLC, a Georgia limited liability company (“Dialogica,” “we,” “us”).
By using the site or requesting prototype access, you agree to these terms and acknowledge our Privacy Policy. You must be at least 18 to use the site. If you use the site on behalf of a company, you agree to these terms on its behalf and confirm that you have the authority to do so. If you don't agree, please don't use the site.
Using the site
The site gives general information about Dialogica and our services. Nothing on it is an offer to provide services. Our project commitments, pricing, ownership terms and service levels are set only in a signed written agreement. If a signed agreement conflicts with these terms, the signed agreement controls.
When you use the site, you agree not to do the following:
- Use it in a way that breaks the law or infringes anyone's rights.
- Try to get around passwords, access controls or other security measures.
- Scrape, crawl or copy the site with bots or other automated tools, or use its content to train AI models. Search engines that follow our robots.txt file are welcome.
- Interfere with how the site works, or introduce malicious code.
- Pretend to be someone else, or give us false information when you request access.
Prototype access
Some prototypes and demos are available only with credentials we issue. If we give you access, the following rules apply:
- Access is personal. Your credentials are for you only. Don't share them, and tell us right away if you think someone else has used them.
- Use it to evaluate working with us. You may use a prototype only to decide whether to work with Dialogica, and for no other purpose.
- Don't copy or rebuild it. Don't record, reverse engineer or recreate any prototype, its screens or its workflows. Screenshots may be shared only as the Confidentiality section allows. Don't use what you see to build or improve a competing product or service.
- The data isn't real. Unless we tell you otherwise, the names, companies, projects and figures in our prototypes are sample, fictional or anonymized data.
- Don't add sensitive data. Don't enter your own confidential, regulated or personal data into a prototype unless we have agreed to it in writing.
- It's a work in progress. Features may change, stop working or never become a product.
- We can end access. We may suspend or revoke access at any time, for any reason, without notice.
Confidentiality
Prototypes, non-public screens, pricing and other information we share with you through gated parts of the site are confidential to Dialogica. You may share them only with colleagues at your company who need them to evaluate working with us and who have confidentiality obligations at least as protective as this section. You must protect them at least as carefully as you protect your own confidential information, and never with less than reasonable care.
This section doesn't apply to information that is or becomes public through no fault of yours, that you already knew or developed independently, or that you must disclose by law. If the law requires you to disclose it, tell us first where the law allows.
If you and Dialogica have signed a separate nondisclosure agreement, that agreement controls where it overlaps with this section. This section continues to apply after your access ends.
Intellectual property
The site and everything on it, including text, graphics, screenshots, software, prototypes and design, belong to Dialogica or its licensors and are protected by intellectual property laws. Dialogica and our logos are our trademarks. We give you a limited, revocable, non-transferable right to view the site for its intended purpose. We don't grant you any other rights.
Other product and company names, including Anthropic and Claude, belong to their owners. Their appearance here does not mean they endorse Dialogica, apart from any partnership we describe.
If you send us ideas or feedback about the site or our products, we may use them without any obligation to you. This doesn't cover documents or business information you share for us to evaluate your needs. We keep those confidential.
Information, not advice
Case studies, examples, time savings, cost estimates and other results on the site are for illustration only. Your results will depend on your systems, data and team. Nothing on the site is legal, financial, tax, regulatory or compliance advice.
When we describe third-party products or their terms, such as Anthropic's plans, we are summarizing them. The provider's own current terms control.
No warranties
The site and all prototypes are provided “as is” and “as available.” To the fullest extent the law allows, Dialogica disclaims all warranties, whether express, implied or statutory. That includes warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We don't promise that the site will be uninterrupted, error-free, secure or free of harmful components.
Limitation of liability
To the fullest extent the law allows, Dialogica and its owners, employees and contractors are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or business opportunities, arising from your use of the site or any prototype. This applies even if we were told such damages were possible.
Our total liability for any claim arising from the site or any prototype is limited to one hundred U.S. dollars (US $100). Some jurisdictions don't allow certain limitations, so some of this section may not apply to you.
Indemnity
You agree to defend, indemnify and hold harmless Dialogica and its owners, employees and contractors from any claims, losses and expenses, including reasonable attorneys' fees, that arise from your breach of these terms or your misuse of the site or any prototype.
Links and third-party services
The site may link to websites, products and services that other companies run. We don't control them and aren't responsible for their content, terms or privacy practices. Using them is at your own risk and subject to their terms.
Changes and termination
We may update these terms from time to time. The date at the top of this page shows when they last changed. If you keep using the site after a change, you accept the updated terms. We may suspend or end your access to all or part of the site at any time, for any reason.
Governing law
These terms are governed by the laws of the State of Georgia, without regard to its conflict of laws rules. Any dispute arising from these terms or the site will be resolved exclusively in the state or federal courts located in Georgia, and you consent to their jurisdiction.
General
If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a right, we haven't waived it. You may not transfer your rights under these terms without our written consent, but we may transfer ours. These terms, together with our Privacy Policy, are the entire agreement between you and Dialogica about the site. Any signed agreement or nondisclosure agreement between us still applies on its own terms. Sections that by their nature should survive, including Confidentiality, Intellectual property, No warranties, Limitation of liability, Indemnity and Governing law, continue after your use of the site ends.
